Introduction: About our Acceptable Use policy (Last Updated: Tue Apr 30 10:25:13 CDT 2002)

As our system grows, it becomes important to make a few issues clear. I'm not really interested in running a ISP that is loaded with restrictions. I do think the policy is a fair one, interested in protecting you as an valued customer. 

From time to time, we will add, delete, alter content of this acceptable use policy.  It is your responsibility to check them often. If you have question about the policy that is listed herein, please Email: security@isot.com

For customer that is new to state of Texas, or currently reside within the state of Texas, these state law may be found applicable.

Dialup Account Policy

  • Reasonable Attentive use / Multiple (Concurrent) Dialup Sessions Policy

All dialup (Non-Business, Non-Dedicated) accounts support only one connection at any given time. Concurrent sessions are logged, and user will be informed (via Email) if multiple (concurrent) session do occur. Repeated con-current attempts grounds for immediate termination of service.

It is our goal to provide you with the highest quality service available, that can be accessed at all time with no busy signals.  To maintain our non-busy signal policy, we monitor our dialup modem pool to ensure that you as our member, are be able to gain access to the service at all time.

However, account which remains in session for a long period of time with very little data transferred is considered abusing the system, since `tie-ing' up a line and not using it prohibit other members to login and obtain their services in a uninterrupted manner. 

  • Personal / Dedicated Non-Business Accounts / Additional Email boxes policy

These accounts are for single user, single session use only. Use of an account by someone other than the account owner, or a member of the immediate household, will be considered grounds for immediate account termination.

Additional e-mail accounts are available for members of a household. In order for e-mail accounts to be added for use in an office or business, commercial services must be established. Addition of e-mail accounts for use by others in a business, or use of a dialup account by more than one person in a business or office can result in termination of service.

  • Account Usage

Our dialup accounts are un-metered access, reasonable use accounts, capped with 650 hours per month. This means that they are not dedicated lines, and customers should not leave their systems dialed in, and leave their system unattended. All users exceeding 650 hours in a month will not be able to login again until first day of the following month.  The use of routers is strictly prohibited for personal dialup accounts and it will not be supported.

  • Confidentiality and Privacy Issues

ISOT  treats private e-mail and/or packets as confidential and will not access, use or disclose the contents of an Authorized User's private e-mail and/or packets to anyone other than addressees, authorized recipients, or those to whom such disclosure is necessary to assure forwarding or delivery, unless ISOT or its representatives, in their sole discretion, have reason to believe or suspect that access or disclosure is necessary (i) to comply with Applicable Law or valid legal process, (ii) to protect the rights or property of ISOT, or (iii) due to suspected illegal activity or when physical safety is at risk, as determined on a case-by-case basis at ISOT's sole discretion.  ISOT will use reasonable care to protect the confidentiality of private e-mail exchanged over its system, but expressly disclaims any responsibility for guaranteeing the privacy of any information transmitted, received or stored by an Authorized User.

ISOT  reserves the right to access any information on the system for the purpose of providing service and/or to protect the security of the system or the rights or property of ISOT, including, but not limited to, any rights afforded to ISOT or its Authorized Users under the Electronic Communications Privacy Act of 1986, as it may be amended from time to time.

ISOT may use for its own purposes non-public information regarding system use by any user and any information regarding the contents of public postings. ISOT will not reveal to any third party any detailed, non-public information that identifiably discloses any user's specific use of the system, unless such disclosure is required to operate the system, by authorized demands of law enforcement authorities, or by court order compelling disclosure of information within ISOT's control.

  • Copyright Issues and Hacking

It is your responsibility to determine the legal status of any software you use or transmitted through our systems.  Much of the material available on the network is copyrighted to some extent, and distribution of those software may be founded in violation of copyright laws, and may result in severe civil and criminal penalties.  We cannot and will not review the information that passed thru our system.  Breaking these agreement will be grounded for immediate account termination.

We consider the exchange of information about security mechanisms to be protected speech. However, traffic in access codes, credit card numbers, or other sensitive information is a crime that we take seriously. We expect you to respect the rights and privacy of all users and to use your account only for lawful purposes.

  • Using Electronic Mail (aka E-Mail)

Some members have complained that after downloading / installed a new email reader from the internet and it causes computer not to receive email properly.  Please do not call for technical support and then get upset at us cause your new email reader is not working and you are unable to receive email. You can always consult our mail support page to see the configuration instruction for your email client. If you still have problem, and just can not get your email software going for some strange reasons, click here to check your email instead. 

Unacceptable Email Use includes:

  • Unsolicited e-mail advertising (SPAM)

    The cost of delivering an e-mail message is paid about equally by the sender and the recipient. This is unlike other media such as physical mail, telephone, TV, or radio. Sending someone mail may also cost them in other ways like network bandwidth, disk space or CPU usage. This is the fundamental economic reason why unsolicited commercial e-mail is unwelcome.

    Using ISOT mail servers to send unsolicited bulk commercial e-mail will result in immediate termination of service.

  • Chain Letters / Pyramid Schemes

    Federal laws prohibit chain letters and pyramid schemes. If you are found to be posting these to news or sending them via e-mail, your account will be terminated.

  • Malicious Email

    Repeatedly sending anyone e-mail with the intent to harass or harm their account (i.e., "flooding" or "mail bombing") is strictly forbidden. Participating in such event will result in immediate account termination.

  • Age Issues

Because the nature of internet allows adult material to be distributed freely, all minor MUST have a parent or guardian sign the service Order Form. Fabricating a age which is inconsistent with your actual age on the Service Order Form will be grounds for account dismissal.

  • Technical Support

Technical support is provided for your convenience, however we can not provide technical support on software downloaded from the internet, we will try to assist you if you have any problems with software downloaded from the internet. Please refer to the technical support provided with that particular software. Also, in the event that you download a software from the internet and it causes your system not to respond as it normally did, please do not blame us for it.

  • Web Traffic

All dialup accounts comes with 55 megabytes of space for web page and 5 megabyte of personal storage, and up to 1.4 gigabits of bandwidth is allocated to a account per month.  Additional bandwidth may be purchased on the account upgrade session under our product & services web site.

When you exceed your maximum allowed bandwidth that is allotted to you, your web site will be automatically shut down.  Until you purchase additional bandwidth from us, your site will remain down. If not, the site will automatically be activated on the first day of the following month.

  • USENET News

The internet is a sprawling network. Not one entity is responsible for its total content. As a host on this network, users may have access to material on other hosts, that may be considered offensive. We are -not- responsible for that material. ISOT is also spools incoming articles transmitted from other hosts. Again, this material may turn your stomach. Sorry, but if you don't like it, don't read it

The content of USENET newsgroups is not regulated by ISOT. Therefore we are not liable for its content. Please do not contact us regarding copyright issues, inflammatory posts, etc.


Limitation of Liability

Neither ISOT, its affiliates, subsidiaries, divisions, officers, directors, employees or agents (collectively, the "ISOT Representatives"), or any of the parties who supply Content to the system make any warranty concerning the accuracy of any Content found on or exchanged through the system. Although ISOT makes every effort to ensure all data is backed up and replicated in case of hardware failure, it is ultimately the end-users responsibility to insure they have a backup of their email, files, address, web pages, databases, etc.  ISOT is not responsible for the loss of any data due to hardware failure or end-user deletion. WITH THE EXCEPTION OF THE EXPRESS REPRESENTATIONS SET FORTH IN THIS ACCESS AGREEMENT AND/OR THE ISOT's RULES, ISOT REPRESENTATIVES, AND ALL PARTIES SUPPLYING CONTENT THROUGH THE SYSTEM HEREBY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SUBSCRIBER/USER EXPRESSLY AGREES THAT USE OF THE INTERNET SERVICES IS AT SUBSCRIBER'S/USER'S SOLE RISK, AND SUCH SERVICES ARE PROVIDED ON AN "AS-IS," "AS AVAILABLE" BASIS. THE SOLE AND ENTIRE MAXIMUM LIABILITY OF ISOT, THE ISOT REPRESENTATIVES, AND ALL PARTIES SUPPLYING CONTENT THROUGH THE SYSTEM TO ANY SUBSCRIBER OR USER FOR ANY AND ALL LOSS, CLAIM, DAMAGE OR LIABILITY OF ANY KIND SHALL CONSIST OF A DUTY TO REFUND AMOUNTS PAID BY THE SUBSCRIBER TO SUCH PARTY DURING THE YEAR PRECEDING SUCH LOSS, CLAIM, DAMAGE OR LIABILITY. OTHER THAN AS EXPRESSLY SET FORTH IN THIS SUBSCRIBER AGREEMENT AND/OR THE ISOT RULES, EACH SUBSCRIBER/USER BY SIGNING THE SUBSCRIBER AGREEMENT AND/OR THROUGH THE CONTINUED USE OF THE INTERNET SERVICES WAIVES ANY AND ALL CLAIMS RELATING TO THE USAGE OF CONTENT MADE AVAILABLE THROUGH THE SYSTEM WHETHER SUCH CLAIMS ARE AGAINST ISOT, THE ISOT REPRESENTATIVES, OR ANY OTHER PERSON WHO HAS SUPPLIED CONTENT TO THE SYSTEM. IN NO EVENT SHALL ISOT, THE ISOT REPRESENTATIVES, OR ANY PARTIES SUPPLYING CONTENT THROUGH THE SYSTEM BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES.
